Houssed.com provides this service (“we” or “us” or “Site”) to assist participating website users and visitors (“Users”) enrich their experience when it comes to buying a property.

It is essential to accept the following terms and conditions (the “Terms of Service & Usage”) and the terms of our Privacy Policy to receive the Service (including access to this Site) via mobile, tab, laptop or other application devices.

Houssed.com is owned and operated by Houssed Technologies Pvt Ltd (“Company”), incorporated under the Companies Act, 2013, and has its registered office at UB-2, Savoy Chambers, Santacruz West, Mumbai-400054.

The expression “Company” shall, unless repugnant to the context thereof, be deemed to include its respective representatives, administrators, officers, employees, agents, directors, successors and assigns.

The Company has the sole and exclusive right to change or modify the Terms without prior permission or intimation to the user. So, the user expressly agrees that any change to the Terms shall come into effect immediately.

If deemed appropriate by us, the user will be notified of material changes to the Terms or the Policy when accessing the website. Notwithstanding the previous, the user acknowledges and agrees to the duty to check the Terms periodically and stay updated on its requirements. If the User continues to use the Website following such a change, the User will be deemed to have agreed to any amendments/modifications made to the Terms.

This document, along with the Privacy Policy, constitutes an electronic record under the Information Technology Act of 2000 and any related rules, as well as the revised sections dealing with electronic records in various legislations as amended by the Information Technology Act of 2000.

The ‘Terms of Use’ is an electronic record within the meaning of the applicable law. It is the electronic record generated by a computer system without any physical or digital signatures.

Services Offered By Houssed

Houssed.com is an aggregator platform that directly connects homebuyers to homebuilders without involving any third party. Through Houssed.com the homebuyers access information, pictures, videos and other allied data. The platform recommends, promotes and advises the user per their requirements and needs.

Other services of Houssed include:

Property site visit
Transactional support
Customer relationship manager
Other allied services like home loans, interior designer, financial planning, etc
Rewards

Houssed Rewards Policy:

The customer has to go through the official website and book the site visit through the Portal.
As per the builder policy, the buyer must give the booking credit to Houssed.
Rewards will be allocated within 90 days of apartment registration.
The company has the right to make the final decision for rewards in case of any disputes or grievances.
The rewards will not include cash; they must be prizes based on company policy.
Prizes and Rewards will vary as per the offers rolled out by the company for a certain period.
The company will decide the rewards based on the purchase price of the property by the customer.
No customer can claim the rewards until the company approves and validates the claims.

Acceptance of the Terms and Conditions

Houssed.com agrees to provide the User, and the User agrees to avail from Houssed the Services based on this Agreement.

The User’s acceptance of the Terms and Conditions and Privacy Policy is the agreement between the User and Houssed. This Agreement shall replace all previous arrangements between the User and Houssed concerning the Services and Site access.
The User undertakes the agreement as binding whenever the User accesses the Site and completes the registration process.
The User agrees with Houssed that the User is 18 (eighteen) years of age or above and can perform and adhere to the agreement.

Individuals under the age of 18 (eighteen) may access the website or avail a Service only with the involvement, supervision, guidance, and/or prior consent of their parents and/or legal guardians, through the profile of or under the direction of such parent/ legal guardian. Houssed shall not be responsible for verifying whether the User is at least 18 (eighteen) years of age.

Access to the site

First-time Users can access the Site for prior browsing without creating an Account.
The User undertakes and agrees to provide user information, upload content and create an Account to retrieve specific information and avail the Services.
Houssed shall verify the Account by requesting a one-time password (OTP) from the User. The User agrees that a mobile number can only be used once to create an Account, and the User is prohibited from creating multiple Accounts.

Houssed can conduct appropriate verification to detect such multiplicity of Accounts and take appropriate action.
The User undertakes to cooperate with any of Houssed personnel in connecting with the User’s access to the Site, as required by Houssed.

User information

Houssed shall not be responsible for the accuracy, quality, integrity, legality, reliability, appropriateness and Intellectual Property Rights concerning the project information.
Houssed shall not be responsible for the deletion, correction, destruction, damage, loss or failure to store any User Information, in whole or in part.
Houssed reserves the right to withhold access, remove or discard any User Information from the website, in whole or in part, at its sole discretion
Houssed shall have the right but not an obligation to maintain or forward any User Information and to verify the authenticity of any User Information made available to it through the website or otherwise.

Disclaimers on the accuracy and completeness of the content/listings

At their own expense, the user should conduct checks to determine the legitimacy of any project or property, including the accuracy of its title, carpet area, and suitability for purchase.
As a listing platform, Houssed.com cannot authenticate the accuracy of content in its Services. The team uploads a lot of content, and because of human error or rapid updates from the builder’s end, there may be inaccurate information. We will address any complaints with the appropriate action.
Important Considerations:
1. Verify the builder’s credentials by performing a thorough ownership check.
2. To verify that the builder’s claims are accurate and that the property is not an “imaginary” one, personally visit the project site or property.
3. Beware of forged title documents. Disputed or long-vacant properties may secure loans against them.
4. We strongly advise thorough due diligence on the property before getting into a real estate deal.
5. The User should independently ensure that the seller abides by the Real Estate (Regulation and Development) Act 2016 and that these rules apply to the project or property in question.

Houssed.com is displaying this information on our Website / Mobile App based on information provided by the Developer of such a Project. Please verify all the information and carefully read the terms and conditions mentioned in the documents before making any decisions. Further:

Houssed takes reasonable efforts to ensure that Houssed provides meaningful information and that it is requested to be updated regularly by the Houssed team; there is a chance that the information displayed is not current and complete;
The images/photos provided here include the artist’s impression of the Project. Essential qualities may differ from such representations.

Home Loan services: If you express interest in obtaining a home loan, you hereby consent and authorize us to share your personally identifiable information with financial institutions offering home loan products and/or services, and such financial institutions may contact you via phone, email, or SMS regarding your home loan interest. This consent supersedes any Do Not Call (DNC) Or National Do Not Call (NDNC) registration.

Indemnification and Limitation of Liability: Each User agrees to indemnify, defend and hold harmless the Company and its affiliates, including but not limited to its (and its affiliates) officers, consultants, directors, agents and employees (“Indemnities”) from and against any and all losses, liabilities, claims, demands, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by the Indemnities that arise out of, result from, or may be payable under, any breach or non-performance of any representation, covenant, warranty, or agreement made or obligation to be performed by such User according to these General Terms of Use. Furthermore, each User agrees to hold the Indemnities harmless from any third-party claims arising out of or in connection with such User’s use of the Website or Services, violation of the General Terms of Use, or infringement of any other person’s rights, including intellectual property rights.

In no circumstances shall the Indemnities be responsible to the Users or any third party for any special, consequential, incidental, indirect, or punitive damages of any kind, including those resulting from loss of data, use, or profits, whether or not foreseeable or whether or not the Company has been advised of the potential of such damages, arising out of or in connection with:

User’s use of or access to the Website, materials on the Website, or Services; or
Any Registered Service Provider can deliver services.

Arbitration: If a dispute arises between a user/users and Houssed.com in connection with the validity, implementation, interpretation, or alleged breach of any provision of these terms and conditions, the dispute will be referred to a sole Arbitrator who will be an independent and neutral third party identified by Houssed.com. The Arbitrator’s decision is final and binding on both parties to the dispute. The arbitration will take place in Mumbai, Maharashtra. The Arbitration and Conciliation Act of 1996. The arbitration proceedings will be governed by the Arbitration and Conciliation Act of 1996.

Grievance Redressal Mechanism: Any complaints, abuse, or concerns about the content and/or comments, or any breach of these terms, must be immediately reported to the Grievance Officer through email at [email protected]. Any grievance received by the Company will be resolved as soon as possible.
